1. PROMOTING ENTITY
1.1 The pre-qualifying tender is promoted by the Government of

1.2 The mail concerning this pre-qualification tender may be sent

2. TENDER SCOPE
2.1 The scope of the tender is to select a maximum of 5 (five)
candidates which shall be consulted in the following phase of
the tender for the execution of the piece-work of DESIGN AND
CONSTRUCTION OF THE GENERAL LAND FILL AND DRAINAGE AT AN
AREA BETWEEN ... AND ....
2.2 The general characteristics of the piece-work are described
in a separate document.
2.3 The work owner holds the right to halt the tender proceedings
without any compensation to the bidders.
3. TENDER TYPE
3.1 The tender is a pre-qualifying type and is in the [country]'s
ambit.
3.2 The tender is open to companies registered with the .. (..
Works Department) for work projects.
3.3 The drawings of the project must be done by technicians registered
with the DSSOPT for the purpose of project's preparations.
3.4 The bidders must guaranty the supply of materials for the
land fills and catch drains.
4. REGISTRATION
4.1 The tender registration is done by filling up a REGISTRATION
FORM at the location referred to in 1.1
4.2 At the moment of registration, the bidders shall fill in the
Registration Form and receive a receipt proving their registration
and a document containing the regulations of the pre-qualifying
tender. Comparing their copies with the elements displayed is
the responsibility of the party interested.
5. QUESTIONS AND EXPLANATIONS
5.1 The bidders may request by means of a letter typed in [language]
directed to the coordinator, any explanations related to the tender,
within the period established in the Schedule, however the requests
made after the referred dates won't be considered.
5.2 Such questions shall be collected and made know in anonymous
form to all bidders inscribed together with the proposals and
explanations deemed necessary before the fixed dates established
in the Schedule, becoming therefore an integral part of the tender
regulations.
5.3 The elaboration, at the proper time, of the answers and explanations
referred to in 5.2 is competence of the ....
5.4 If any meeting is held to further explain the tender regulations,
the inscribed bidders must be duly convened and a minutes containing
the matters discussed at the meeting shall be transcribed and
sent to all registered bidders, becoming therefore a part of the
tender proceedings.
5.5 If the explanations are not supplied within the period established
in the Schedule shall imply an extension of the term for presentation
of proposals, as long as such extension is requested by any of
the bidders.
6. INSPECTION OF WORKS LOCATION
During the term for the tender, the parties interested may inspect
the location where works are to be executed and perform there
any surveys deemed indispensable for presentation of their proposals,
verifying the land conditions that may affect the method of execution
of the work.
7. NOTICES
Any notices or requests required by the tender regulations, or
any that are allowed to be done in accordance with its terms,
shall be considered done if proof can be presented that such have
been presented by hand, mail, telegram, telex or fax, to the party
to whom such request or notice is supposed to be presented, at
the addresses indicated in the present document and in the Registration
Form.
8. PROPOSALS PRESENTATION
8.1 The proposals must be presented before 5.30 p.m. of the [day]
of August, [year], by the bidders or their representatives at
the ...'s main office, against issuing of receipt, or sent by
mail by means of registered letter with notice of reception.
8.2 If the proposal's presentation is done by mail, the bidder
shall be solely responsible for any delays that may occur, having
no right to protest in case the presentation of the proposal's
documents be done out of date.
9. PROPOSAL'S FORMAT
9.1 The proposal shall be elaborated according to the annexed
model and written in the Portuguese language, without corrections,
words written between the lines or crossed out, always with the
same type of machine if typed or with the same calligraphy and
ink if handwritten.
9.2 The proposal shall be signed by the bidder or his representative.
If the proposal is signed by a proxy, a power of attorney must
be attached granting powers to that effect, or a public form of
the same, duly certified.
10. PARTNERSHIP
10.1 Partnership of companies is allowed for sharing different
phases of the process.
10.2 When there is partnership of companies, the proposals presented
by the bidders must include a statement of commitment for the
partnership if their candidature is selected with the indication
that the partnership leader shall be the bidding company and that
such company will assume the commitment to form a specific partnership
for this piece-work, taking on full responsibility for its execution.
10.3 A duly certified and legal declaration must be presented
stating that the partnership companies grant powers to the bidder
to be their proxy in the [country], with powers to sign everything
deemed convenient or necessary on the behalf of the partnership.
11. DOCUMENTS INFORMING THE PROPOSAL
11.1 The proposal must include the following documents:
a) Certified declaration by the bidder, stating his name, marital
status, address, or if a company, the name of the company, registered
office, the branches with interest to the contract execution,
name of the Directors and other persons with powers to bind the
company, commercial registration of the incorporation and amendments
to the articles of association, and that has no debts to Public
Finances by owing fees and taxes due in the last three years.
b) If it happens to be a company, certified copies of the commercial
registration of the incorporation and amendments to the articles
of association.
c) Document of proof of Industry Tax payment in the most recent
year.
d) In the case of foreign companies a statement must be presented,
declaring that it shall comply with the ... legislation and Court
of Law, renouncing any other Court.
e) Document proving registration at the [country's registry office]
f) Annexed bidders questionnaire.
11.2 In case of partnership, the elements referred to in 11.1
must be presented concerning each one of its entities.
11.3 When the documents referred to in the previous numbers are
not written in the Portuguese language, they must be presented
together with a certified translation.
11.4 Any deficiencies in the preparation of the proposals may
be arranged during the analysis period of the same, the work owner
shall notify the respective bidder to present the missing elements
within a term stipulated for that effect.
12. PROPOSAL AND OTHER DOCUMENTS METHOD OF PRESENTATION
Along with the original, the bidders must present two copies of
the proposal, all elements must be closed in a opaque package,
closed and sealed, labeled with the bidder's name and the inscription:
"PROPOSAL FOR PRE-QUALIFYING TENDER CONCERNING PIECE-WORK
OF CONCEPTION AND CONSTRUCTION OF GENERAL LAND FILL AND CATCH
DRAINS AT THE AREA BETWEEN ... AND ...".
13. PROPOSAL'S VALIDITY
After a term of ninety days counting from the date the proposals
are opened, cease their obligation to keep their proposals for
the bidders who have not received communication to have been selected
for the next phase.
14. OPENING OF PROPOSALS
The proposals shall be opened by a commission appointed for that
purpose in a public session to be held on the [day] of August,
[year], at 9.30 a.m., at the address indicated in 1.1.
15. BIDDERS EXPLANATIONS
15.1 Concerning the documentation contained in their proposals,
the bidders are obliged to give explanations deemed necessary
to the presiding entity, in order to evaluate the guaranties for
good technical execution of the piece-work, or any other with
general or local public interest.
15.2 During the phase destined to the analysis of the proposals,
if at any time the presiding entity encounters any doubts concerning
the economic and financial situation or yet the technical ability
of any of the bidders, it could be requested before the awarding,
consultation of any document or information deemed necessary,
including accounts, in order to dissipate such doubts.
16. PROPOSAL PREPARATION CHARGES
The expenses with proposal preparations are on the account of
the bidder.
17. CRITERIA FOR QUALIFICATION
During the analysis of the proposals the following selection criteria
shall be applied:
a) Company's curriculum in execution of similar works.
b) Company's curriculum executing this type of work in the [country].
c) Curriculum of the designer's team in the preparation of similar
projects.
d) Composition of technical team for the execution of the work.
e) Equipment to be used in the execution of the work.
f) Materials supply guaranty, which is decisive for selection.

indicating how long they have been employed.
2.4.3 Composition of the team to execute the work, specifying
their respective rank and professional curriculum.

4. LIST OF ESTIMATED AND AVAILABLE EQUIPMENT FOR THE EXECUTION
OF THE PIECE-WORK AND LAND AND SEA MEANS OF TRANSPORT
In furnishing these elements it should be taken into account that
the transportation of sand through sea route is feasible.
